Terms And Conditions of Residential Installation Services

Terms & Conditions – Residential Holiday Light Installation Services

These Terms & Conditions govern the residential holiday light installation services offered through the Rhode Island & the Riverhead Holiday Light Show™ (the “Show”). By booking an installation, you acknowledge and agree to the following:

1. Services Provided Solely by Installer

All installation services are provided exclusively by either Rockhouse Construction (if located in Rhode Island / Massachusetts) or Island Illuminations (if located on Long Island) (the “Installer”). The Show and its operators do not perform installation services.

2. No Warranty or Guarantee

We do not warrant, guarantee, or make any representations regarding the quality, safety, durability, or workmanship of the Installer’s services or materials. Any warranties, if available, are provided solely by the Installer.

3. Covenant Not to Sue

By booking installation services, you agree not to bring any legal action, claim, or demand against the Show, its owners, affiliates, or operators relating to installation services.

4. Hold Harmless – Errors or Omissions

You agree to hold the Show and its operators harmless from any liability, errors, or omissions in connection with the installation services, whether caused by us or the Installer.

5. Hold Harmless – Installer Actions

You agree to hold the Show and its operators harmless from any damages, losses, injuries, or liabilities arising from the actions, omissions, or negligence of the Installer or from the use of installation services.

6. Limited Role of Show

Our sole role is to facilitate the referral of customers to the Installer. We do not supervise, control, or direct the Installer’s work, and we are not responsible for any aspect of the installation.

7. No Agency Relationship

No partnership, joint venture, employment, or agency relationship exists between the Show (or its operators) and the Installer. The Installer operates as an independent contractor.

8. Payment Terms

  • For Rhode Island/Massachusetts customers:

    • At the time of booking, a 50% non-refundable deposit is required and paid directly to the Show.

    • The remaining 50% balance is due to the Installer at the time of installation.

    • Deposits are non-refundable under all circumstances, including but not limited to cancellations, rescheduling, or dissatisfaction with services.

    • The Show is not responsible for the collection of the remaining balance, which is the sole responsibility of the Installer.

  • For New York customers:

    • At the time of booking, a 33.3% non-refundable deposit is required and paid directly to the Show.

    • The remaining 66.7% balance is due to the Installer at the time of installation.

    • Deposits are non-refundable under all circumstances, including but not limited to cancellations, rescheduling, or dissatisfaction with services.

    • The Show is not responsible for the collection of the remaining balance, which is the sole responsibility of the Installer.

 

9. Scheduling & Availability

All installation dates and times are scheduled and managed solely by the Installer. The Show and its operators make no guarantees regarding scheduling, availability, or completion times.

 

10. Permits & Approvals

It is the homeowner’s responsibility to obtain any required permits, approvals, or permissions (including HOA or municipal approvals). Neither the Show nor its operators are responsible for such requirements.

 

11. Limitation of Liability

To the fullest extent permitted by law, the Show and its operators disclaim any and all liability for damages, including but not limited to indirect, incidental, or consequential damages, arising from or related to the installation services.

 

12. Accuracy of Information

The customer is solely responsible for providing accurate information, including but not limited to property details, electrical availability, and site access. Additional costs resulting from inaccurate information shall be the customer’s responsibility.

 

13. Force Majeure

Neither the Show nor the Installer shall be held liable for delays or failures caused by events beyond reasonable control, including but not limited to weather, power outages, labor shortages, or acts of God.

 

14. Modification of Terms

The Show reserves the right to amend or update these Terms & Conditions at any time by posting an updated version online. Continued use of installation services constitutes acceptance of the revised Terms.

15. Governing Law & Venue

  • For residents of Rhode Island & Massachusetts, these Terms are governed by the laws of the State of Rhode Island. Any disputes shall be resolved exclusively in the courts located within Rhode Island.

  • For residents of New York, these Terms are governed by the laws of the State of New York, county of Suffolk. Any disputes shall be resolved exclusively in the courts located within New York.

16. Acceptance of Terms

By booking an installation, you acknowledge that you have read, understood, and agreed to these Terms & Conditions in full.
